House Republicans introduce amendment guaranteeing medical treatment for babies born alive

WOBURN — A pair of House Republicans filed an amendment Tuesday that would ensure that all babies born alive in Massachusetts are guaranteed lifesaving medical treatment.
The amendment, according to its co-sponsors, Rep. Alyson Sullivan of Abington and Marc Lombardo of Billerica, was drafted in response to recently filed legislation.
Earlier this month, Beacon Hill Democrats hatched a scheme to take advantage of an overdue state budget by tacking on radical pro-abortion legislation as a “budget” amendment, even after House Speaker Robert DeLeo directed members not to submit policy measures during the budget-making process.
On Friday, Gov. Charlie Baker rejected Section 40 of the 2021 state budget, the ROE Act-inspired amendment. Baker’s version keeps in place state parental consent laws for minors seeking an abortion, a provision Democrats sought to overturn in their “budget” amendment.
Sullivan and Lombardo praised the governor’s decision to send the amendment back to the state Legislature, but both stressed the need for language to be included that protects the right to lifesaving medical care for babies born alive.
“I applaud Gov. Baker for expressing his opposition to certain provisions within the (Section 40) budget amendment and returning it to the Legislature,” said Sullivan. “I share Gov. Baker’s objections and concerns with allowing 16 and 17-year-olds to get an abortion without parental or guardian participation.
“Additionally, it is unconscionable for any society to permit by way of late-term abortions the killing of a child moments before or after he or she is delivered.”
The Democrats’ proposal includes language canceling the current state law requiring physicians to provide lifesaving medical treatment to babies born alive during failed abortions.
The amendment being introduced by Sullivan and Lombardo, meanwhile, seeks to protect living, breathing, infants.
“I don’t know how anyone could possibly remain opposed to a law requiring that newborns receive lifesaving medical care,” Lombardo said. “But I look forward to hearing the Democrats’ explanation.”
The Sullivan/Lombardo amendment, titled “Preservation of medical services for babies born alive,” reads as follows:
“If an abortion is performed pursuant to section 12N, the facility where the abortion is performed shall maintain life-supporting equipment, as defined by the department of public health, the physician performing the abortion must use life saving measures to preserve the life and health of a live birth and the patient.”
